IF YOU RECEIVED NOTICE FROM API FINANCIAL SOLUTIONS INDICATING THAT YOUR PRIVATE INFORMATION MAY HAVE BEEN IMPACTED IN A DATA INCIDENT, A PROPOSED CLASS ACTION SETTLEMENT MAY AFFECT YOUR RIGHTS.
A Settlement has been reached with API Financial Solutions, Inc. (“API” or “Defendant”) in a class action lawsuit concerning the personal data of individuals placed on a computer drive by API and mailed but lost in transit thereafter. The drive contained a variety of personally identifying information, which for some individuals included Social Security numbers and financial account information. The class action alleges API was, among other things, negligent in its handling of class member data.
The lawsuit is captioned Schleicher v. API Financial Solutions, Inc., Case No. 4:23-cv-01431, currently pending in the United States District Court for the Eastern District of Missouri (the “Action”).
API denies each and all claims and contentions alleged against it in the Action and denies all charges of wrongdoing or liability alleged (or which could have been alleged) in the Action, including as to the validity of the “class” of people asserted.
You are included in the Settlement Class if you were sent a notice of the Data Incident. Your rights are affected by this Settlement whether you act or not. Please read this Notice carefully and completely.

OPT OUT OF THE SETTLEMENT | You can choose to opt out (that is, exclude yourself) from the Settlement. OBJECT TO THE SETTLEMENT AND/OR ATTEND A HEARING | If there is something about the Settlement you don’t like, you may object to it by writing an objection that will be provided to the Court. DO NOTHING | Unless you opt out of the settlement, you are automatically part of the Settlement. Your rights and options—and the deadlines to exercise them—are explained in the Notice.
The Court in charge of this case still has to decide whether to approve the Settlement.
Capitalized terms in the notice have the meaning assigned to them in the Settlement Agreement. The Settlement Agreement is available for your review HERE.
